My dad's bank mistakenly declared him deceased and initiated foreclosure proceedings

I’m really worried about my elderly dad’s situation in Kansas. The bank that holds his mortgage thinks he’s dead and started foreclosure even though we’ve been making regular payments plus extra.

We can’t log into the account or pay anything now. The bank says they’ve noted he’s alive but we’re still locked out.

Is this legal? Don’t they need proof he’s actually passed away or missed payments for months before foreclosing?

I’m scared they’re trying to take advantage of an older person. Has anyone dealt with something like this before? What should we do next?

I just want to help my dad keep his home. Any advice would be much appreciated!

omg thats so messed up!! banks can be such jerks sometimes :rage: my aunt had sumthing similar happen, it took forever to fix. def get a lawyer asap and maybe call ur local news station? they love stories like this. dont let those greedy bankers win!!

Oh wow, that’s such a scary situation for your dad! Have you considered reaching out to a local elder law attorney? They might have experience with similar cases. I’m curious, how long has this been going on? Have you tried contacting any consumer protection agencies? Keep us updated!

This is a serious issue that needs immediate action. First, document everything - all communications with the bank, payment records, and attempts to resolve the situation. Then, file a formal complaint with the Consumer Financial Protection Bureau. They can intervene on your father’s behalf. Also, send a certified letter to the bank’s legal department demanding account reinstatement and foreclosure cancellation. If they don’t comply quickly, consult an attorney specializing in elder law or foreclosure defense. Time is critical in these cases, so act swiftly to protect your father’s home and rights.
